Terms of Use

1 · Agreement to These Terms

BrainLush Media Inc. (“Flying Fillies,” “we,” “us”), a Delaware corporation, owns and operates flyingfillies.com (the “Site”), including its store. These Terms of Use are a binding agreement between you and BrainLush Media Inc. By accessing or using the Site, you agree to be bound by these Terms of Use and our Privacy Policy, which is incorporated by reference. If you do not agree, you may not access or use the Site.

A child may access the Site only with the permission and under the supervision of a parent or legal guardian. By permitting a child to access the Site, the parent or legal guardian accepts these Terms of Use on the child’s behalf and is responsible for the child’s use of the Site. We do not ask children to accept these Terms of Use.

Our store and our contact form are for adults (18 years of age or older) only.

2 · License Grant and Restrictions

Subject to your compliance with these Terms of Use, BrainLush Media Inc. grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and its content solely for your personal, non-commercial use. Teachers may also use the Site and its content with their students for non-commercial classroom teaching, provided all copyright, trademark, and other proprietary notices remain intact. All rights not expressly granted in these Terms of Use are reserved by BrainLush Media Inc.

You agree not to:

(a) use any Flying Fillies characters, stories, text, artwork, photographs, videos, audio, or other content for any commercial purpose, including on products, merchandise, advertising, or social media promotions, without a signed license from BrainLush Media Inc.;

(b) copy, modify, distribute, sell, or republish any Site content, except as expressly permitted above;

(c) use any robot, scraper, or other automated means to access, collect, or harvest Site content, except (i) standard search-engine indexing of public pages, and (ii) AI assistants and AI search services reading public pages in order to answer questions about Flying Fillies, cite it, and link to the Site;

(d) use any Site content to train or fine-tune any artificial intelligence or machine-learning model, or to create AI-generated versions of Flying Fillies characters, stories, artwork, or voices;

(e) frame, mirror, or embed any part of the Site, or link to it in a manner that suggests affiliation with or endorsement by BrainLush Media Inc.;

(f) interfere with, disrupt, decompile, reverse engineer, or attempt to gain unauthorized access to the Site or its systems;

(g) impersonate BrainLush Media Inc. or misrepresent any affiliation with it; or

(h) use the Site in violation of any applicable law.

3 · Intellectual Property

All Flying Fillies content on the Site, including without limitation the Flying Fillies name and logo; the book Flying Fillies: The Sky’s the Limit, its text and excerpts; all characters and their names, likenesses, personalities, and stories; cover art, artwork, photographs, videos, and podcast episodes; and the Site’s text, design, and overall look and feel (collectively, “Flying Fillies Content”), is owned by BrainLush Media Inc., Christy Hui, or their licensors and protected by the copyright, trademark, and other intellectual property laws of the United States and international treaties. FLYING FILLIES and all related names, characters, logos, and trade dress are trademarks of BrainLush Media Inc. Nothing in these Terms of Use transfers ownership of, or grants any license to, Flying Fillies Content, except the limited license in Section 2.

4 · Unsolicited Submissions

BrainLush Media Inc. does not accept or consider unsolicited ideas, stories, manuscripts, artwork, pitches, or other creative materials (“Submissions”). Parents and guardians must not permit children to send us Submissions. If you send a Submission despite this policy: (i) it will be deemed non-confidential and non-proprietary; (ii) BrainLush Media Inc. has no obligation to review, return, or compensate you for it, and may delete it without review; (iii) no confidential, fiduciary, or implied-contract relationship is created; and (iv) you waive any claim that any Flying Fillies Content, whether created before or after your Submission, is based on or infringes your Submission.

5 · The Store: Orders, Payment and Delivery

Our store is for adults (18 years of age or older). By placing an order, you confirm that you are 18 or older.

  • Orders. We may decline or cancel an order, for example if an item is out of stock or was listed with an error. If we cancel an order you have paid for, we refund it in full.
  • Prices and payment. Prices are in U.S. dollars. The total, with any shipping charge and tax, is shown at checkout before you pay. Payment is taken by our payment provider when you place your order.
  • Delivery. We ship within the United States only. Some items ship to the contiguous United States only, as shown on the product page. We pack and ship orders ourselves.
  • All sales are final. We do not accept returns or exchanges. The one exception: if an item arrives damaged, defective, or wrong, we replace it or refund it. Tell us within 14 days after delivery, at hello@flyingfillies.com, with a photo.
  • Your information. Our Privacy Policy explains how we handle order information.

6 · Business Inquiries and Licensing

Our contact form is intended solely for adults (18 years of age or older), for customer support and for business inquiries, including book distribution, speaking engagements, interviews, licensing, partnership, press, and trade inquiries. Nothing on the Site constitutes an offer to license, sell, or otherwise transfer any rights in Flying Fillies Content. Buying a book or another item from our store gives you that copy only, not any rights in Flying Fillies Content. Any commercial use of Flying Fillies Content requires a written license agreement signed by an authorized officer of BrainLush Media Inc. No inquiry, discussion, or correspondence creates any license, partnership, joint venture, agency, or other obligation unless and until it is set forth in a written agreement signed by BrainLush Media Inc. Press materials may be used only as approved in writing by BrainLush Media Inc.

7 · Third-Party Links and Services

The Site may contain links to, or embedded content from, third-party websites and services, including Amazon, YouTube, Instagram, Facebook, and X, which BrainLush Media Inc. does not own or control. BrainLush Media Inc. is not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of any third-party site or service is at your own risk and subject to its terms. Links to stores, social media and other third-party sites are intended for adults. Some links go to stores such as Amazon. As an Amazon Associate we earn from qualifying purchases.

8 · Infringement and Enforcement

Flying Fillies, including all of its names, characters, world, and elements, was created by Christy Hui and is owned by BrainLush Media Inc., Christy Hui, or their licensors. Unauthorized or prohibited use of Flying Fillies Content, by you or a business you represent, without the express written authorization of BrainLush Media Inc., infringes our rights and may subject you to civil liability, criminal prosecution, or both, including economic, punitive, and enhanced damages to the fullest extent of the law, legal fees, court orders, and civil and criminal penalties. BrainLush Media Inc. actively enforces its rights.

Reporting misuse. If you are an adult and become aware of any unauthorized use of Flying Fillies Content, including unlicensed merchandise, copied text or artwork, pirated copies of the book, fake accounts, or AI-generated imitations, please report it to hello@flyingfillies.com with a link or image and where you found it.

9 · Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL FLYING FILLIES CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BRAINLUSH MEDIA INC. DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU USE THE SITE AT YOUR OWN RISK. Section 5 sets out what we do if a store order arrives damaged, defective, or wrong.

10 · Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BRAINLUSH MEDIA INC. OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS OF USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL THE TOTAL LIABILITY OF BRAINLUSH MEDIA INC. TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT, IF ANY, PAID BY YOU TO BRAINLUSH MEDIA INC. THROUGH THE SITE FOR THE ORDER THAT GAVE RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11 · Changes and Termination

BrainLush Media Inc. may modify these Terms of Use at any time. We will post notice of material changes on the Site before they take effect and update the “Last updated” date above. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms of Use. BrainLush Media Inc. may modify, suspend, or discontinue any part of the Site at any time, and may restrict or terminate your access to the Site at its sole discretion, for any reason, without notice or liability.

12 · Governing Law and Venue

These Terms of Use are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. You consent to the exclusive jurisdiction and venue of the state and federal courts in Delaware for any dispute arising out of or relating to the Site or these Terms of Use, and you waive any objection based on venue or inconvenient forum. BrainLush Media Inc. may also take action wherever an infringer is located to stop misuse of Flying Fillies Content or to enforce a judgment.

13 · Miscellaneous

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and BrainLush Media Inc. with respect to the Site and supersede all prior or contemporaneous communications, whether electronic, oral, or written. In the event of any conflict between these Terms of Use and any other terms or policies on the Site, these Terms of Use shall prevail. If any provision of these Terms of Use is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect. Our failure to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. These Terms of Use are personal to you and may not be assigned or transferred by you. BrainLush Media Inc. may assign or transfer its rights and obligations under these Terms of Use without restriction. Any provision that by its nature should survive termination, including Sections 2 through 12, shall survive.
